What's A Title Search?

The title to your home is the legal proof of your ownership. When a house is purchased, the property’s history is reviewed to determine if the title is clear and free of defects before the sale is closed. Virginia Title Company provides title examination services for new and existing homes. We provide Owner’s Title Insurance to protect the owner after the sale and Lender’s Title Insurance to insure the lender for the amount of the mortgage.

During the title examination, we check to see if the deed was recorded properly when the property changed hands. We look for any outstanding liens or judgments against previous owners and determine if the property was part of a divorce settlement or an estate. We examine the survey, noting easements or other restrictions on the land. When a problem does come up, we work towards its resolution.  

The most thorough title examination may fail to uncover some hidden defects. Anything that can be done to resolve questionable issues helps reduce the risk of future problems. Except for cases requiring legal counsel, we handle everything.

  Forgery
  Inadequate Surveys
  Fraud in connection with execution of documents
  Incorrect legal descriptions
  Undue influence on a grantor or executor
  Non-delivery of goods
  False personation by those purporting to be owners of the property
  Unsatisfied claims not shown on record
  Incorrect representation of the marital status of grantors
  Undisclosed or missing heirs
  Wills not properly probated
  Mistaken interpretation of wills and trusts
  Mental incompetence of grantors
  Conveyance by a minor
  Birth of heirs subsequent to date of will
  Unsatisfied claims not shown on record
  Deeds executed under expired or false powers of attorney
  Confusion due to similar or identical names
  Dower or curtesy rights of ex-spouses of former owners
  Incorrect indexing
  Clerical errors in recording legal documents
  Delivery of deeds after death of grantor
